GENERAL PROVISIONS
The online store www.aside-brand.com operates in accordance with the rules set out in these Terms and Conditions.
The Terms and Conditions specify the terms of concluding and terminating Product Sales Agreements, the complaint procedure, as well as the types and scope of services provided electronically by www.aside-brand.com, the rules for providing these services, and the conditions for concluding and terminating agreements for electronic services.
Each Customer, upon taking actions aimed at using the Electronic Services of www.aside-brand.com, is obliged to comply with these Terms and Conditions.
In matters not regulated by these Terms and Conditions, the following legal provisions shall apply:
- The Act on Providing Services by Electronic Means of July 18, 2002,
- The Consumer Rights Act of May 30, 2014,
- The Act on Out-of-Court Resolution of Consumer Disputes of September 23, 2016,
- The Civil Code of April 23, 1964, and other applicable provisions of Polish law.
DEFINITIONS CONTAINED IN THE TERMS AND CONDITIONS
ORDER FORM – a form available on the website www.aside-brand.com that allows the placement of an Order.
CLIENT – a natural person, legal entity, or organizational unit without legal personality but having legal capacity, making a purchase from the Seller directly related to their business or professional activity.
CONSUMER – a natural person who enters into a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
ENTREPRENEUR – a natural person, legal entity, or organizational unit without legal personality that has legal capacity granted by law, conducting business or professional activities in their own name.
PRODUCT – a movable item available in the Store that is the subject of the Sales Agreement between the Client and the Seller.
CART – a list of products compiled from the items offered in the Store based on the Buyer's selections.
BUYER – both the Consumer and the Client.
DELIVERY – a type of transport service along with the specification of the carrier and the cost, listed in the delivery price list.
TERMS AND CONDITIONS – these regulations of the Store.
STORE – the online store operated by the Service Provider at www.aside-brand.com.
SELLER, SERVICE PROVIDER – WEAR CODE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, registered at Felicjanek 17/S-4, 31-103 Kraków, Poland.

SALES AGREEMENT – a Sales Agreement for a Product concluded between the Client and the Seller via the Store.
ORDER – the Client’s declaration of intent constituting an offer to conclude a Sales Agreement for a Product with the Seller.
PRICE – the value expressed in monetary units that the Client is obligated to pay the Seller for the Product.
CONSUMER LAW – the Consumer Rights Act of May 30, 2014.
PRODUCT INFORMATION AND ORDERING
The online store www.aside-brand.com sells Products via the Internet.
The Products offered in the Store are new, comply with the agreement, and have been legally introduced to the Polish market.
The information available on the Store’s website does not constitute an offer within the meaning of the law. By placing an Order, the Client submits an offer to purchase a specific Product under the conditions specified in its description.
The Product price displayed on the Store’s website is provided in Polish zloty (PLN) and includes all applicable components. The price does not include delivery costs.
Orders can be placed through the website using the Order Form (www.aside-brand.com) – 24 hours a day, all year round.
A prerequisite for placing an Order in the Store is that the Client reads and accepts the Terms and Conditions at the time of placing the Order.
CONCLUSION OF THE SALES AGREEMENT
To conclude a Sales Agreement, the Client must first place an Order using the method provided by the Seller, in accordance with § 3 points 5 and 6 of the Terms and Conditions.
After placing the Order, the Seller immediately confirms its receipt.
The confirmation of Order acceptance, as referred to in point 2 of this section, binds the Client to their Order. The confirmation of receipt of the Order is sent via email.
The Order confirmation includes:
- A confirmation of all essential elements of the Order,
- A withdrawal form,
- These Terms and Conditions, including information on the right of withdrawal.
Upon receiving the confirmation email, as mentioned in point 4 of this section, a Sales Agreement is concluded between the Client and WEAR CODE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ.
Each Sales Agreement will be confirmed by a proof of purchase, which will be included with the Product.
PAYMENT METHODS
The Seller provides the following payment methods:
- Payment via an electronic payment system.
For payments made through the electronic payment system, the Client must complete the payment before the Order is processed. The electronic payment system allows payment via credit card or instant bank transfer from selected Polish banks.
The Client is required to make the payment for the Sales Agreement within 24 hours from the moment of placing the Order.
The Product will be shipped only after payment has been received.
COST, DELIVERY TIME, AND SHIPPING METHODS OF THE PRODUCT
The delivery costs of the Product, which are covered by the Customer, are determined during the ordering process unless otherwise stated in the offer.
The delivery time of the Product consists of the order processing time and the delivery time by the carrier:
- The order processing time is 3 business days; however, the store reserves the right to extend this period during sales and promotional campaigns.
- The delivery of movable goods by the carrier is carried out within the time frame declared by the carrier, i.e., 3 business days from the moment the shipment is dispatched (deliveries are made only on business days, excluding Saturdays, Sundays, and public holidays).
Products purchased in the Store are shipped exclusively within Poland via a courier company.
Return of Shipment Due to Non-Collection by the Customer
If the customer fails to collect the shipment and it is returned to the sender (seller), the customer bears the return shipping costs. These costs include both the cost of returning the package to the seller and any additional costs related to processing the return. This fee will be deducted from the refund amount for the order or added to the cost of the next shipment if the customer decides to reorder the product.

INTERNATIONAL SHIPPING
1. Delivery Scope
The Seller offers shipping to selected European Union countries, including Germany, France, the Netherlands, and Italy. Orders can only be delivered to addresses located in these countries – we do not ship to P.O. boxes or parcel lockers outside of Poland.
2. Shipping Costs and Methods
a) The cost of international shipping is covered by the Customer. The shipping fee depends on the destination country, weight and dimensions of the package, and the selected delivery method. The current rates are displayed during the checkout process.
b) Shipping is carried out by postal operators or courier companies cooperating with the Seller. The Customer can choose from the available delivery methods at the time of finalizing the order.3. Processing and Delivery Time
a) The estimated delivery time depends on the destination country and the chosen shipping method, ranging from 3 to 14 business days on average.
b) The Seller is not responsible for delays caused by factors beyond their control, such as carrier delays, customs inspections, natural disasters, or other unforeseen circumstances.4. Payment
a) The Customer can make a payment using only the methods available in the Store, including:
- Selected payment gateways
- Online bank transfers (e.g., Przelewy24)
- Debit or credit cards
All payments must be completed before the order is shipped. Cash on delivery is not available for international shipments.
5. Taxes and Customs Fees
a) All prices in the Store include VAT in accordance with applicable regulations.
b) No customs duties apply to deliveries within the European Union; however, the Customer is responsible for reviewing local tax regulations and covering any additional charges imposed by the destination country’s authorities.
c) The Seller is not responsible for additional costs such as local taxes or administrative fees that may be applied by customs authorities in the country of delivery.6. Responsibility for Shipment
a) The Customer is responsible for providing a correct and complete delivery address. The Seller is not liable for undelivered shipments due to incorrect address details provided by the Customer.
b) If the package is damaged during transport, the Customer must file a claim directly with the carrier in accordance with their policies. The Seller may assist with the claim process but is not directly responsible for damages caused by the shipping company.7. Returns and Right to Withdraw from the Contract
a) The Customer has the right to withdraw from the contract and return the product within 14 days of receiving the order, in accordance with EU distance selling regulations.
b) The cost of returning an international shipment is covered by the Customer unless the return is due to the Seller’s error (e.g., incorrect item shipped or defective product).
c) Returned products must be unused, with original tags and packaging intact. Returns of damaged, soiled, or used items may be rejected or refunded with a deduction based on the product’s depreciation.8. Uncollected Shipments
a) If the Customer fails to collect the shipment and it is returned to the Seller, reshipping is possible only after the Customer covers additional transportation costs.
b) If the Customer decides not to proceed with reshipping, the Store will refund the order amount, deducting the shipping costs and any additional fees incurred by the Seller.
PRODUCT COMPLAINTS
Complaint Due to Non-Conformity of the Product with the Contract
- The basis and scope of the Seller's liability towards the Customer who is a Consumer for non-conformity of the Product with the contract are defined by the Consumer Rights Act of May 30, 2014.
- The basis and scope of the Seller’s liability towards the Customer who is a Business Entity under warranty are defined by the Civil Code Act of April 23, 1964.
- The Seller is responsible for any non-conformity of the Product with the contract that existed at the time of delivery and was revealed within 2 years from that moment, unless a longer shelf life has been specified by the Seller or an entity acting on their behalf.
- Complaints regarding non-conformity of the Product with the contract and submission of relevant claims can be made in writing to the address: ul. Felicjanek 17/17, 31-103 Kraków.
- The written complaint should include as much information and detail as possible about the subject of the complaint, particularly the type and date of the defect occurrence and the Customer’s contact details. The provided information will help facilitate and expedite the complaint resolution process.
- To assess the defect and non-conformity of the Product with the contract, the Consumer is required to provide the Product to the Seller. The item should be properly secured and sent to: Wear Code Spółka z o.o., Kaja Adamus, ul. Felicjanek 17/17A, 31-103 Kraków, along with a signed complaint form in paper form.
- The Seller will respond to the Customer’s request promptly, but no later than 14 days from the date of filing the complaint.
- If the complaint is submitted by a Consumer and remains unresolved within 14 days, it is deemed accepted.
If the Consumer's Complaint is Justified, the Seller will:
- Cover the costs of repair or replacement and re-deliver the Product to the Customer.
- Reduce the price of the Product (the reduced price must be proportional to the value of the conforming Product compared to the non-conforming one) and refund the Consumer the difference within 14 days of receiving the Consumer’s price reduction declaration.
- In the case of contract withdrawal by the Consumer, the Seller will refund the Product price within 14 days of receiving the returned item.
The response to the complaint will be provided in writing or on a durable medium, such as an email or SMS.
WARRANTY (STATUTORY WARRANTY – RĘKOJMIA)
- The Seller, pursuant to Article 558 §1 of the Civil Code, fully excludes liability for physical and legal defects (statutory warranty) towards Customers who are Business Entities.
- The Seller is liable towards the Consumer under the terms specified in Article 556 and subsequent articles of the Civil Code for defects (statutory warranty).
- In contracts with Consumers, if a physical defect is found within one year from the date of delivery, it is presumed that the defect existed at the time of risk transfer to the Consumer.
If the sold item has a defect, the Consumer may:
- Submit a statement requesting a price reduction, or
- Submit a statement of withdrawal from the contract,
unless the Seller promptly and without excessive inconvenience to the Consumer replaces the defective item with one free of defects or removes the defect. This limitation does not apply if the item has already been replaced or repaired by the Seller or if the Seller has failed to meet the obligation to replace or repair the defective item.

The Consumer may, instead of the Seller’s proposed defect removal, request a replacement of the item with one free of defects or, instead of a replacement, request defect removal, unless making the item conform to the contract in the manner chosen by the Consumer is impossible or would incur excessive costs compared to the method proposed by the Seller. When assessing excessive costs, the value of a defect-free item, the type and significance of the defect, and the inconvenience to the Consumer of an alternative means of fulfillment are considered.

The Consumer cannot withdraw from the contract if the defect is insignificant.
If the sold item has a defect, the Consumer may also:
Request a replacement of the item with one free of defects, or
Request removal of the defect.
The Seller is obligated to replace the defective item with one free of defects or remove the defect within a reasonable time and without excessive inconvenience to the Consumer.
The Seller may refuse to accept a complaint if the defect is insignificant, or if it results from the nature of the material from which the product is made and occurs due to normal use.
If the Consumer is entitled to a replacement or withdraws from the contract, the Seller must accept the defective item in return.
The Seller will respond within fourteen days to:

- A statement requesting a price reduction,
- A request for replacement with a defect-free item,
- A request for defect removal.
If the Seller fails to respond within this period, the complaint is considered accepted.
RIGHT OF WITHDRAWAL FROM THE CONTRACT

Subject to point 10 of this section, a Customer who is also a Consumer and has concluded a distance contract has the right to withdraw from it without providing any reason by submitting a relevant statement within 14 days.

In the event of withdrawal from the contract, the Sales Contract is considered null and void, and the Consumer is obliged to return the Product to the Seller no later than 14 days from the date of withdrawal. The deadline is met if the Product is sent back before the period expires.

The Consumer is responsible for any reduction in the value of the Product resulting from handling it in a manner exceeding what is necessary to determine its nature, characteristics, and functionality, unless the Seller has failed to inform the Consumer or the entity referred to in §10 about the method and deadline for exercising the right of withdrawal and has not provided them with a withdrawal form. To assess the Product’s characteristics and functionality, the Consumer should handle and inspect the Product only as they would in a physical store.

Subject to points 6 and 8 of this section, the Seller will refund the value of the Product using the same payment method that the Consumer used. Subject to point 7 of this section, the refund will be made immediately, but no later than 14 days from the date the Seller receives the Consumer’s statement of withdrawal from the Sales Contract.

The Consumer must return the Products at their own expense and risk. Cash-on-delivery (COD) shipments will not be accepted.

The Seller will refund the Product price and the cost of shipping the Product to the Consumer, up to the amount of the lowest available shipping fee in the Seller’s offer. The Seller does not cover the return shipping costs incurred by the Consumer when sending the Product back.
- For orders shipped outside the European Union, the Seller will refund only the value of the purchased goods. The original shipping cost is non-refundable.

The right to withdraw from a distance contract does not apply to the Consumer in cases where the Sales Contract concerns:
- A custom-made product, manufactured according to the Consumer’s specifications or designed to meet their individual needs.

The right to withdraw from the Sales Contract applies to both the Seller and the Customer in cases where the other party fails to fulfill their contractual obligations within a strictly defined period.
PRE-ORDER – TERMS OF SERVICE
Purchasing through the pre-order system on www.aside-brand.com allows Customers to reserve exclusive apparel before it enters production. This process ensures access to unique products that are not yet available for regular sale.
Order Fulfillment Time
- Every pre-order placed in the Store will be fulfilled within 14 business days from the date of the order.
- This period does not include the shipping time to the Customer.
Nature of Pre-Order Products
- Products purchased via pre-order are not custom-made or specifically tailored for each Customer.
- All items are part of a planned production series, and their features are not adjusted based on individual preferences.
Payment Terms
- Full prepayment is required for all pre-order purchases.
- Payment must be made immediately after placing the order to confirm it and initiate production.
Right of Withdrawal
- Customers have the right to withdraw from the contract for a pre-order product in accordance with the general withdrawal policy stated in the Store’s Terms & Conditions.
- The withdrawal period is 14 days from the date of receiving the product.
Order Modifications
- If a Customer needs to modify a pre-order after placing it, they should contact the Seller immediately.
- The Seller will make every effort to accommodate changes, but modifications are not guaranteed, especially after the production process has started.
Product Availability
- If an order cannot be fulfilled due to reasons attributable to the Seller, such as production limitations, the Customer will be notified immediately.
- In such cases, the full payment will be refunded to the Customer.
Policy Updates
- www.aside-brand.com reserves the right to modify the pre-order terms.
- Customers will be informed about any changes through updates to the Store’s Terms & Conditions available on the website.
TYPE AND SCOPE OF ELECTRONIC SERVICE
- The Service Provider enables Customers to conclude Sales Contracts for products through the Store.
- The provision of electronic services to Customers is governed by the Store’s Terms & Conditions.
- The Service Provider reserves the right to display advertising content on the Store’s website. These advertisements are an integral part of the Store and its presented materials.

TERMS OF SERVICE AND CONTRACTING FOR ELECTRONIC SERVICES

The provision of the Electronic Service specified in § 9 point 1 of the Terms & Conditions by the Service Provider is free of charge.

The contract for the provision of an Electronic Service, which enables the placement of an Order in the Store, is concluded for a fixed period and terminates when the Order is placed or when the User discontinues the ordering process.
Technical Requirements
To ensure compatibility with the Service Provider's telecommunication system, the following technical requirements must be met:
- A computer or mobile device with Internet access,
- Access to email,
- An up-to-date web browser,
- Cookies and JavaScript enabled in the web browser.

The User is obligated to use the Store lawfully and ethically, respecting the personal rights and intellectual property rights of third parties.

The User must provide data that is accurate and truthful.

The User is prohibited from submitting or distributing any unlawful content through the Store.

COMPLAINTS REGARDING THE PROVISION OF ELECTRONIC SERVICES

Complaints related to the provision of Electronic Services through the Store may be submitted by the User to WEAR CODE SPÓŁKA Z O.O. via email at: contact@aside-brand.com.

The email complaint should include as many details and circumstances as possible regarding the issue, particularly:
- The type and date of the reported irregularity,

Contact details of the User.
Providing this information will help facilitate and expedite the complaint review process by the Service Provider.

The Service Provider will process the complaint promptly, no later than 14 days from the date of submission.

The Service Provider’s response to the complaint will be sent to the email address provided in the complaint submission or through another method specified by the User.

The Seller is committed to protecting personal data in accordance with:

FINAL PROVISIONS

Contracts concluded through the Store are governed by Polish law.

If any provision of these Terms & Conditions is found to be inconsistent with applicable law, the relevant provisions of Polish law shall apply in its place.

Any disputes arising from Sales Contracts between the Store and Consumers shall initially be resolved through negotiations, with the intention of amicable settlement, taking into account the provisions of the Act on Out-of-Court Consumer Dispute Resolution.
- If an amicable resolution is not possible or is unsatisfactory for either party, disputes shall be settled by the competent common court, in accordance with point 4 of this section.

Any disputes arising between the Service Provider and a Consumer shall be submitted to courts competent under the provisions of the Civil Procedure Code of November 17, 1964.

A Consumer also has the right to use alternative dispute resolution (ADR) methods, including:
- Submitting a mediation request or a request for dispute resolution by an arbitration court after completing the complaint procedure (the request form is available at: UOKiK Download).
- A list of Permanent Consumer Arbitration Courts operating at Regional Trade Inspection Offices is available at: UOKiK Addresses.
- The Consumer may also seek free assistance from a district (municipal) consumer ombudsman or a consumer protection organization.
- Out-of-court dispute resolution is free of charge after the completion of the complaint process.

1. Organizator Konkursu:

7. Ogłoszenie Wyników:
Zwycięzca zostanie ogłoszony na profilu Instagram ASIDE w Insta Stories po zakończeniu konkursu i poinformowany za pośrednictwem wiadomości prywatnej oraz w komentarzu.
8. Nagroda:
Nagrodą w konkursie jest sukienka Bonita od ASIDE.
9. Zasady Nagrody:
Nagroda nie podlega wymianie na gotówkę ani inną formę rekompensaty. Nie jest możliwe odstąpienie prawa do nagrody osobom trzecim.
10. Organizator zastrzega sobie prawo do zaproponowania zwycięzcy innego modelu sukienki jeśli rozmiar zwycięzcy nie będzie dostępny.
11. Organizator zastrzega sobie prawo do unieważnienia konkursu, zakończenia go bez rozstrzygnięcia lub zmiany warunków bez wcześniejszego powiadomienia.
12. Akceptacja Regulaminu:
Udział w konkursie oznacza akceptację niniejszego regulaminu.
13. Wyłączenie Odpowiedzialności Instagrama:
Promocja nie jest sponsorowana, popierana ani przeprowadzana przez Instagram ani z nim związana. Instagram jest zwolniony z odpowiedzialności przez każdego uczestnika.
14. Ochrona Danych Osobowych:
Uczestnictwo w konkursie wiąże się z przetwarzaniem danych osobowych uczestników, co jest uzasadnione realizacją konkursu. Podanie danych jest dobrowolne, lecz niezbędne do udziału w konkursie.
